Welcome to Danyel Cosmetics and Marli Skin Care. This website and store (the "Services") are operated by Danyel Cosmetics, Inc. ("we," "us," "our"). Our store is powered by Shopify.

These Terms of Service ("Terms"), along with the policies they reference, describe your rights and responsibilities when you use the Services. They include important information about your legal rights, including warranty disclaimers and limits on our liability, so please read them carefully.

By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

1. Access and account

By using the Services, you confirm you're at least the age of majority where you live, and that you've given consent for any minor dependents to use the Services on devices you own or manage.

To shop with us, you may need to give us information like your email, billing, payment, and shipping details. You confirm that this information is correct, current, and complete, and that you have the right to provide it.

You're responsible for keeping your account login secure and for all activity on your account. You may not transfer, sell, or share your account with anyone else.

2. Our products

We work hard to show our products accurately. Colors and shades can look different depending on your screen, device settings, and lighting, so what you see online may not match the product exactly.

We don't guarantee that the look or performance of any product will meet your expectations or match exactly how it appears online. Product descriptions, formulas, and availability may change without notice. We may discontinue products and may limit quantities per person, region, or order.

3. Skin sensitivity and product use

Our products are made for sensitive skin, but every person's skin is different. Before using any new product:

  • Read the full ingredient list on the product page or packaging, especially if you have known allergies or sensitivities
  • Do a patch test: apply a small amount to your inner arm or behind your ear and wait 24 hours
  • Use products only as directed
  • Stop using any product that causes redness, irritation, swelling, or discomfort, and talk to a doctor if it doesn't clear up

Our products are cosmetics. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on our site, including product descriptions, blog posts, or advice from our team, is medical advice. If you have a skin condition or are pregnant or nursing, check with your doctor or dermatologist before using a new product.

4. Orders

Placing an order is an offer to buy. We may accept or decline any order at our discretion, and an order isn't accepted until we confirm it and receive your payment. Please review your order before submitting, since we may not be able to cancel it once it's accepted. If we decline, change, or cancel an order, we'll try to reach you using the email, phone, or address you gave us.

Orders placed through this site are for personal or household use, not for resale. If you're a retailer or salon interested in carrying our products, contact us at info@danyelcosmetics.com about wholesale.

5. Returns

We accept returns of unused products within 30 days of delivery, and we cover return shipping. Full details are in our Refund Policy, which governs all returns and exchanges.

6. Prices and billing

Prices, discounts, and promotions can change without notice. You'll pay the price in effect when you place your order, as shown in your order confirmation. Unless stated otherwise, prices don't include taxes, shipping, or customs and import charges.

Prices on our site may differ from prices at our Authorized Retailers or other stores. Promotions may have their own terms; if those conflict with these Terms, the promotion terms apply.

You agree to give us current, complete, and accurate purchase and payment information and to keep it up to date. You confirm that you're authorized to use the payment method you provide and that you'll pay all charges at the posted prices, including shipping and applicable taxes.

7. Shipping and delivery

We process orders within 1 to 2 business days. Delivery times are estimates, not guarantees, and we aren't responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you once we hand your order to the carrier. International customers are responsible for any customs duties or import fees.

8. Intellectual property

Everything on the Services, including trademarks, brand names, text, images, graphics, product reviews, video, audio, and the design and arrangement of the site, is owned by Danyel Cosmetics, Inc., its affiliates, or its licensors and is protected by U.S. and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not copy, distribute, modify, republish, or create derivative works from any material on the Services without our written permission. Nothing in these Terms gives you a license to any of our intellectual property, Shopify's, or anyone else's. All rights not expressly granted are reserved.

Danyel Cosmetics, Marli Skin Care, and our logos, product names, designs, and slogans are trademarks of Danyel Cosmetics, Inc. You may not use them without our written permission. Shopify's name and marks belong to Shopify. Other names and marks on the Services belong to their respective owners.

9. Third-party tools

We may give you access to tools provided by third parties, which we don't monitor or control. These tools are provided "as is" and "as available," without warranties or endorsement, and we aren't liable for your use of them. Please review the provider's own terms before using them.

Any new features or tools we add to the Services are also covered by these Terms.

The Services may include links to or content from third-party websites. We aren't responsible for their content, accuracy, products, or practices, and you visit them at your own risk. Questions or complaints about third-party products or services should go to that third party.

11. Relationship with Shopify

Danyel Cosmetics & Marli Skin Care is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Danyel Cosmetics & Marli Skin Care. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Danyel Cosmetics & Marli Skin Care, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Danyel Cosmetics & Marli Skin Care.

12. Privacy

All personal information we collect through the Services is covered by our Privacy Policy. Some information may also be covered by Shopify's Privacy Policy. Because our store is hosted by Shopify, information you submit is shared with Shopify and other service providers, some of which may be located outside your country, so they can provide services to you.

13. Reviews and feedback

If you send us or post reviews, photos, ideas, suggestions, or other content ("Feedback"), you give us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display it in any medium, including in marketing.

By submitting Feedback, you confirm that it's your own, that you've disclosed any free product, payment, or other incentive you received for it, and that it doesn't violate anyone's rights or these Terms. We don't have to keep Feedback confidential, pay for it, or respond to it.

Feedback may not be false, misleading, unlawful, abusive, obscene, or infringing, and may not contain viruses or malware. Don't use a fake email address or pretend to be someone else. We may, but aren't required to, monitor, edit, or remove Feedback we consider objectionable. You're responsible for your own Feedback, and we aren't liable for Feedback posted by you or anyone else.

14. Errors and inaccuracies

The Services may occasionally contain typos, errors, or omissions in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct them, update information, or cancel orders affected by them at any time without notice, including after you've placed an order. If we cancel an order you've paid for, we'll refund you in full.

15. Prohibited uses

You may use the Services only for lawful purposes. You may not use them to:

  1. Do anything unlawful or malicious, or violate any law or regulation
  2. Infringe our intellectual property or anyone else's
  3. Harass, abuse, threaten, defame, or harm our team or anyone else
  4. Share false or misleading information
  5. Send spam, chain letters, or unsolicited advertising
  6. Impersonate any person or business
  7. Interfere with anyone else's use of the Services, or harm or expose to liability Danyel Cosmetics, Inc., Shopify, or other users

You also agree not to:

  1. Upload viruses or other malicious code
  2. Copy, resell, or exploit any part of the Services
  3. Collect or track other people's personal information
  4. Phish, pharm, or pretext
  5. Use bots, scrapers, crawlers, data-extraction tools, or AI agents to access the Services, except as allowed under Section 16
  6. Bypass or circumvent our security, access controls, or robot exclusion headers

We may suspend or close your account without notice if we determine you've violated these Terms.

16. Automated agents

16.1 This section applies if you use, allow, or deploy an "Agent" to access or interact with the Services. An Agent is any software or service that acts autonomously or semi-autonomously on behalf of a person or business without direct supervision.

16.2 An Agent may access the Services only if it identifies itself and follows Section 16.4 at all times, and only if we haven't asked it to stop.

16.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.

16.4 Agents must: (i) identify themselves in every HTTP/HTTPS request by including "Agent/[agent name]" in the user agent string; (ii) not hide that they are an Agent, including by mimicking human behavior or completing or getting around CAPTCHAs or similar checks; (iii) answer truthfully when asked whether they are a human or a computer; and (iv) not get around any measure we use to block, limit, or control Agent access.

17. Termination

We may end these Terms or your access to the Services, in whole or in part, at any time and without notice. You'll still owe any amounts due up to that date.

These sections continue to apply after termination: Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any others that by their nature should survive.

18. Disclaimer of warranties

Information on the Services is for general information only. We don't guarantee its accuracy, completeness, or usefulness, and you rely on it at your own risk.

EXCEPT AS EXPRESSLY STATED BY DANYEL COSMETICS, INC., THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DON'T ALLOW THESE DISCLAIMERS, SO SOME OF THEM MAY NOT APPLY TO YOU.

19. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, DANYEL COSMETICS, INC., SHOPIFY, AND OUR RESPECTIVE AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, INCLUDING ANY ERRORS OR OMISSIONS IN ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. SOME JURISDICTIONS DON'T ALLOW THESE LIMITS, SO SOME OF THEM MAY NOT APPLY TO YOU.

20. Indemnification

You agree to indemnify, defend, and hold harmless Danyel Cosmetics, Inc., Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, owed to a third party because of (1) your breach of these Terms or the policies they reference, (2) your violation of any law or anyone's rights, or (3) your use of the Services.

We'll notify you of any claim covered by this section; a late notice doesn't relieve your obligations unless it materially harms you. We may control the defense and settlement at your expense, including choice of counsel, but won't settle a claim that requires something other than money from you without your consent, which you won't unreasonably withhold. You'll cooperate in the defense, including by providing relevant documents.

21. Severability

If any part of these Terms is found unlawful, void, or unenforceable, it will still be enforced to the fullest extent the law allows, and the rest of these Terms remain in effect.

22. Waiver and entire agreement

If we don't enforce any right or provision of these Terms, that isn't a waiver of it.

These Terms and any policies we post on the Services are the entire agreement between you and us about the Services. They replace any earlier agreements, communications, or versions of these Terms. Any ambiguity in these Terms won't be interpreted against the party that wrote them.

23. Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our written consent; any attempt to do so is void. We may transfer or assign these Terms without notice or consent.

24. Governing law

These Terms are governed by the laws of the State of Tennessee and applicable U.S. federal law, without regard to conflict-of-law rules. You and Danyel Cosmetics, Inc. agree to the exclusive jurisdiction and venue of the state and federal courts located in Sumner County, Tennessee.

25. Headings

Headings are for convenience only and don't affect the meaning of these Terms.

26. Changes to these Terms

The current version of these Terms is always on this page. We may update, change, or replace any part of them by posting the changes here, so please check back from time to time. We'll notify you of material changes as required by law, and they take effect on the date in that notice. Continuing to use the Services after changes are posted means you accept them.
